Cathay Pacific announced on the 24th October, 2018 that it had suffered a catastrophic data leak leading to more than 9.4 million customers like you having their personal data leaked.

This sensitive personal data included full names, some debit/credit card numbers, passport numbers, identity card numbers, historical travel data, home and business addresses and email addresses. The breach is even more serious than that committed by BA in September 2018 in that Cathay Pacific customers like you have suffered from far more substantial personal data being leaked.

Q. WILL I HAVE TO GO TO COURT?

Probably not. If Cathay Pacific insists on defending the case all the way to trial, then a handful of Claimants (likely between 10 and 20) will be selected out of the tens of thousands who will likely participate in this action in order to give evidence. Nevertheless, going to court is nothing to be afraid of since Cathay Pacific in the wrong!

Q. WHAT WILL IT COST ME TO BRING THE CLAIM AGAINST CATHAY PACIFIC?

Nothing upfront. The amount that you will pay will be dependent on various factors such as how long the case takes to settle, the time spent on it and the amount of compensation obtained from Cathay Pacific. Under the terms of this agreement, you will only be liable to pay our fees and expenses, as well as those of barristers, funders and insurers, if the case is successful. The exact amount you will pay will depend upon how long the case takes, how much time the lawyers need to spend on it, and the level of compensation obtain. Unlike some other firms we cap our fees at a maximum of 35% including VAT.

All of the lawyers in the proposed group action are committed to obtaining compensation on your behalf as quickly as possible. As Cathay Pacific is one of the largest companies in the UK, however, it may be necessary to take them to court. If a quick settlement is achieved, you may receive your compensation in the next six months but if Cathay Pacific chooses to fight, it could take two years or so.

Q. HOW WILL YOU BRING MY CLAIM?

We will first try to settle your claim with Cathay Pacific by way of a pre-action letter. If that is unsuccessful, your claim may be brought as part of a Group Litigation Order (a "GLO") which is the mechanism by which the courts in England and Wales manage thousands of cases which are all brought together at the same time.
